Terms of Service

1. Acceptance of Terms

By accessing or using SwarmGen (the “Service”), operated by Swarm Labs IO Ltd (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SwarmGen is a cloud-based image and document generation platform. It allows users to create templates and generate personalised images, PDFs, and other visual assets at scale using dynamic merge fields, API integrations, and automation tools. The Service incorporates AI to assist with template building and content generation. We do not retain or store any AI-generated conversation content.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. You must be at least 16 years old to register.

4. Acceptable Use

You agree not to use the Service to:

• Generate content that is unlawful, harmful, defamatory, or infringes third-party rights
• Produce spam, phishing materials, or misleading advertising
• Upload or incorporate content you do not have the right to use
• Attempt to reverse-engineer, scrape, or abuse the platform infrastructure
• Resell or sublicense access to the Service without prior written consent

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Credits, Billing, and Refunds

Free accounts receive a one-time allocation of render credits. Paid plans are billed monthly and include a set number of renders per billing period. Unused credits may roll over subject to the cap stated on your plan. Credits have no cash value and are non-transferable.

Payments are processed securely via Stripe. All fees are stated in USD. We do not offer refunds for partially used billing periods, but unused credits from a paid plan are available until the end of that period.

6. Intellectual Property

You retain ownership of any templates, content, and data you upload or create using the Service. By uploading content, you grant Swarm Labs IO Ltd a limited, non-exclusive licence to store and process that content solely for the purpose of providing the Service.

SwarmGen, its interface, underlying technology, and system templates are the property of Swarm Labs IO Ltd and are protected by applicable intellectual property laws.

7. Generated Content

Images and documents generated using your templates and data are owned by you. Swarm Labs IO Ltd does not claim any rights over generated outputs. You are solely responsible for ensuring that generated content complies with applicable laws and does not infringe third-party rights.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform maintenance, apply updates, or experience downtime outside our control. We will endeavour to notify users of planned maintenance in advance.

10. Limitation of Liability

To the fullest extent permitted by law, Swarm Labs IO Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, loss of revenue, or loss of business opportunity. Our total liability to you in any month shall not exceed the amount paid by you for the Service during that month.

11. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your access if you breach these Terms, fail to pay for a paid plan, or if we decide to discontinue the Service. Upon termination, your data may be deleted after a 30-day grace period.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or an in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
